David Resnick Associates Secures $2.5 Million Settlement for Bronx Driver Injured in Commercial Vehicle Crash

David Resnick & Associates, P.C., a personal injury law firm serving clients throughout New York City, has secured a $2.5 million pre-trial settlement for a Bronx woman who suffered catastrophic injuries when a commercial vehicle struck the vehicle she was driving. Trial attorney Philip Monier obtained the settlement, which was announced on September 3, 2026.

According to the law firm, the 43-year-old woman sustained severe injuries in the truck crash, including a neck injury requiring surgery to replace a disk with an implant, surgery on her right finger, scar revision procedures, and multiple interventional pain management procedures. She also suffered herniations and protrusions at multiple levels of her spine, along with nerve damage, leaving her permanently disabled and unable to work, as recognized by the federal government.

Before the accident, the woman worked as an occupational therapy assistant, a physically demanding job that required helping patients with balance and strengthening exercises and lifting some patients weighing 200 pounds or more. Her injuries also limited her ability to perform daily activities such as walking, bending, lifting, sitting, driving long distances, sleeping comfortably, and handling household chores.

“The physical toll of the crash was devastating, requiring our client to undergo major surgical intervention and face an incredibly challenging road to recovery,” Mr. Monier said.

The law firm filed the lawsuit in the Supreme Court of the State of New York, Bronx County, seeking compensation for the woman's injuries. The defense was prepared to argue that her injuries were pre-existing and not caused by the crash, and that she was not disabled or impaired because any injuries from the accident had fully healed. However, David Resnick & Associates was prepared to argue that the accident was a substantial factor in causing her injuries and that any pre-existing conditions were aggravated by the collision. The firm also planned to show that the woman remained permanently disabled and would require ongoing treatment and future surgical care.

“By securing this substantial settlement, we were able to provide our client with the financial peace of mind she deserves,” Mr. Monier said. “These funds will help her cover ongoing medical care, specialized rehabilitation, and the long-term support she will require to heal.”

This settlement is notable as it underscores the significant impact that commercial vehicle accidents can have on individuals and the importance of skilled legal representation to ensure fair compensation. It also reflects the firm's commitment to advocating for clients who have suffered serious injuries due to negligence.

Mr. Monier also served as trial attorney in two other recent cases reported by the firm: a $1.925 million settlement for a client injured in a staircase slip and fall, announced June 20, 2026, and a $1.3 million settlement for a client who suffered catastrophic injuries in a fall outside an elevator, announced July 25, 2026.

David Resnick & Associates, P.C., based in Midtown Manhattan, represents clients throughout the New York City area who have been seriously injured due to others' negligence. Founded in 1998, the firm has earned a reputation for obtaining high-value settlements and verdicts for its clients while handling a wide range of personal injury matters, including slip-and-fall accidents, auto accidents, pedestrian injuries, subway and escalator accidents, tenant injuries, construction injuries, and other negligence claims.
